Agreement

These terms apply when you use ohanvi.com or the Ohanvi platform at https://app.ohanvi.com. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

The service

Ohanvi provides WhatsApp Business API messaging, broadcast campaigns, no-code chatbot flows, a shared team inbox, email marketing, social publishing and the analytics across them. We may add, change or retire features; we will not materially reduce what you are paying for without telling you first.

Message delivery depends on Meta and on the other platforms you connect. We do not control their policies, rate limits, quality ratings or outages, and we cannot guarantee delivery of any individual message.

Your account

Keep your credentials confidential and tell us promptly if you suspect misuse. You are responsible for everything done under your account, including by your team members.

Acceptable use

You must comply with the WhatsApp Business Messaging Policy, Meta’s Commerce and Platform terms, India’s TRAI regulations on commercial communication, and all other applicable law. In particular:

• Message only people who have opted in to hear from you, and honour every opt-out promptly.
• Do not send spam, or upload purchased, scraped or otherwise unconsented contact lists.
• Do not send unlawful, misleading, hateful, or infringing content, or anything Meta prohibits.
• Do not attempt to breach, overload, reverse-engineer or resell the platform except under a signed partner agreement.

Why this matters more than usual

Meta scores every business number on how recipients react to its messages, and that score sets your daily sending limit. Sustained policy breach can get a number restricted or banned by Meta directly — an outcome we cannot reverse. We may suspend an account that puts our platform standing at risk, and we will tell you why.

Your data and ours

You keep all rights in the contacts, content and campaigns you put into Ohanvi. You grant us the licence needed to host, process and transmit them to run the service. We keep all rights in the platform itself.

You confirm you have the legal basis to upload every contact you upload, and that you have their consent to message them on the channels you use.

Fees and billing

Subscription fees are billed in advance in the plan you choose. Meta’s per-message charges are billed on top at Meta’s published rate plus a platform fee set by your plan, between 5% and 20%; Meta sets those underlying rates, and both the rates and the way it meters them can change. Fees are exclusive of GST and other applicable taxes.

Payments are non-refundable except where the law requires otherwise. We may suspend the service on continued non-payment after notice.

Third-party platforms

Using Ohanvi to reach WhatsApp, Facebook, Instagram, LinkedIn, Threads or X — or to connect Shopify or a Google Workspace account — also means accepting those platforms’ own terms. Their fees, limits and enforcement decisions are theirs, not ours.

Availability and warranties

We work to keep Ohanvi available and secure, but the service is provided "as is" and we do not warrant that it will be uninterrupted or error-free. Scheduled maintenance will be announced where practical.

Limitation of liability

To the extent the law allows, neither side is liable for indirect, incidental or consequential loss, or for lost profits, revenue or goodwill. Our total liability in any twelve-month period is limited to the fees you paid us in that period. Nothing here excludes liability that cannot lawfully be excluded.

Ending the agreement

You may cancel at any time, effective at the end of the current billing period. We may terminate for material breach, unlawful use, or non-payment. On termination your access ends and we handle your data as set out in the Privacy Policy.

Governing law

These terms are governed by the laws of India, and the courts at Gurugram, Haryana have exclusive jurisdiction.
